Distance Sales Agreement - Emlivo Subscription Terms

This Distance Sales Agreement has been concluded electronically, pursuant to the provisions of Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, between the Seller whose details are set out below and the Buyer who purchases services through the Emlivo website/application.
1. Parties — Seller

2. Parties — Buyer
- •The Buyer is the natural or legal person identified by the first and last name, e-mail, phone number and billing details provided while creating their Emlivo account.
- •By completing the payment step and clicking the "Buy" / "Start Subscription" button, the Buyer declares that they accept all provisions of this agreement in electronic form.
3. Subject of the agreement
- •The subject of this agreement is the provision to the Buyer of the digital services within the Emlivo subscription plan (AI-powered content generation, image/video generation, listing creation, CRM, rent/dues tracking and other tools) that the Buyer orders electronically through the Seller's Emlivo website/application, and the collection of the corresponding price.
- •The Seller clearly states the plan contents and usage limits on the product page and inside the panel.
4. Price, taxes (VAT) and payment
- •The current prices and plan contents of the service are published on the Emlivo "Pricing" page. The amounts shown on that page and on the payment screen are VAT inclusive — i.e. final amounts with taxes already included. Before the order is completed, the Buyer sees and approves the total amount payable including taxes; no additional tax line is added.
- •Payments are collected by credit card and securely (3D Secure) through the Dodo Payments infrastructure, acting as the Merchant of Record. Payments from Turkey are processed in TRY and payments from other countries in USD. Card details are not stored by the Seller. The invoice for these sales is issued by the Merchant of Record, Dodo Payments.
- •Every subscription starts with a 7 (seven) day trial. A $1 trial fee is charged at the start of the trial; the plan fee is not charged during the trial. If you cancel before the trial ends, the plan fee is not taken; the $1 trial fee already charged is non-refundable. At the end of the trial, unless cancelled, the price of the selected plan is automatically charged to your saved card and the subscription begins.
- •If a subscription is selected, billing renews automatically at the relevant period intervals starting from the end of the trial period. An informational e-mail is sent before each renewal.
- •If the amounts cannot be collected (card limit, invalid card, etc.), the Seller may suspend the service.
5. Credit usage and refunds of consumed credits
- •Emlivo services run on a credit basis. When the subscription starts, the monthly credits included in the plan are automatically loaded into the Buyer's account; one-time additional credit packs may also be purchased.
- •Each AI generation deducts the number of credits stated next to the relevant tool from the balance. If a generation fails for technical reasons, the deducted credits are automatically returned to the balance.
- •Credits consumed by successfully completed generations are non-refundable; once a credit is used in a generation, the digital service is deemed instantly performed. Purchased but unused credit balance is likewise covered by the instant-performance exception and is non-refundable, but it remains usable as long as the account is active.
6. Delivery
- •The service is assigned digitally and automatically to the Buyer's account at the moment the payment is approved; there is no separate shipping or physical delivery process.
- •Delivery time: instant. Delivery confirmation is provided through the notification e-mail sent to the user and the subscription status shown in their account.
- •A valid Emlivo account and an internet connection are sufficient to access the service.
7. Right of withdrawal
- •Pursuant to Article 15 of the Regulation on Distance Contracts, "services performed instantly in electronic environment" and "intangible goods delivered to the consumer instantly" are among the exceptions to the right of withdrawal.
- •Since Emlivo is a software service delivered digitally and instantly, the statutory right of withdrawal cannot be exercised once performance of the service has begun. By accepting this agreement, the Buyer acknowledges that they are aware of this exception and that they cannot benefit from the right of withdrawal.
- •Once the 7-day trial ends and that period’s plan fee is charged, if the Buyer has used any of the credits added to their account for that period (i.e. made a generation), the subscription fee for that month is non-refundable; the service is deemed performed for that month. To avoid the plan fee, the subscription must be cancelled before the 7-day trial ends; cancelling during the trial incurs no plan fee (the $1 trial fee is non-refundable).
- •Nevertheless, the Seller offers subscription cancellation and proportional refund options within the good-faith rules set out on the "Delivery and Refund Terms" page.
8. Subscription cancellation
- •The Buyer can cancel their subscription at any time with a single click from the "Settings" section of their account.
- •After cancellation the service can continue to be used until the end of the current billing period; no automatic charge is made on the renewal date.
9. Obligations of the parties
- •The Seller exercises due care to provide the service in accordance with the qualities stated in the agreement, without interruption and with reasonable performance.
- •The Buyer is personally responsible for the security of their account, the legal responsibility of the content they generate, and for not abusing the service (bulk spam, unauthorised data collection, etc.).
- •The Seller is not liable for temporary outages that may arise due to force majeure, third-party infrastructure failures (Vercel, Supabase, AI providers, etc.) or judicial/administrative decisions; in such cases the Seller does its best to restore the service within a reasonable period.
10. Protection of personal data
- •The processing of personal data is explained in detail in the Privacy Policy and the GDPR/KVKK Privacy Notice. By accepting this agreement, the Buyer also declares that they have read and accepted the Privacy Policy and the data protection notice.
11. Settlement of disputes
- •For disputes arising from this agreement; the Consumer Arbitration Committees at the consumer's place of residence are competent within the monetary limits determined each December by the Ministry of Trade, and the Consumer Courts are competent for disputes exceeding that limit.
12. Entry into force
- •This agreement enters into force at the moment it is accepted electronically by the Buyer and remains valid throughout the subscription period. A copy of the agreement is sent to the Buyer's e-mail address and can always be accessed from this page through their account.
